New York State Law states that corporations must be represented by an attorney in court.   I have more than twenty years experience in successfully defending trucking companies and drivers in all Long Island’s  District Courts.** and New York City Criminal Courts*.   If I represent your company, neither the driver or other company employee will have to appear in court, in most cases.   Contact me, Jeanne Marie Beckmann, Esq., for a free consultation at 516 485 4888 to discuss your company’s upcoming court dates.

If your company misses its court date or does not have an attorney appear on its court date, then the company can be found guilty of the charges (including misdemeanor crimes) and maximum fines can be imposed.  This is referred to as a “default conviction” or “judgment”.   If your company received a CRC 39A notice of default conviction and fine payment notice, contact me before the fine payment is due. I can make an application to vacate the default conviction to get the case restored to the calendar and fight the summonses.

If the driver named on the ticket doesn’t appear on the court date, the driving privileges may be suspended and/or an arrest warrant can be ordered by the judge.  The company will save money by hiring an attorney to represent the driver and, in most cases and may be permitted to substitute the driver as the defendant in the action.    This is referred to as “corporate substitution” and is effected by “corporate affidavit”.

I have successfully vacated thousands of dollars in default convictions for companies and vacated arrest warrants and license suspensions for drivers.
