If your company misses its court date or does not have an attorney appear on its court date, then the company can be found guilty of the charges (including misdemeanor crimes) and maximum
fines can be imposed. This is referred to as a “default conviction” or “judgment”. If your company received a CRC 39A notice of default conviction and fine payment notice,
contact the attorney before the fine payment is due, if possible. She can make an application to vacate the default conviction to get the case restored to the calendar to defend the charges so your company doesn't have to pay the fines.
If the driver named on the ticket doesn’t appear on the court date, his/her driving privileges may be suspended and/or an arrest warrant can be ordered by the judge. The company can save money by hiring an attorney to represent the driver and, in most cases and may be permitted to substitute the company for the driver as the defendant in the action. This is referred to as “corporate substitution” and is effected by “Corporate Affidavit” or other paperwork.
